These Terms of Service ("Terms") form a legally binding agreement between you ("you", "your", "User") and Michael Ruocco, trading as Yogen ("Yogen", "we", "us", "our"), governing your access to and use of the Yogen platform and services (the "Service").
By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
These Terms are governed by the laws of England and Wales. Where you are a consumer (an individual using the Service for personal, non-business purposes), you have additional statutory rights under UK consumer protection law that these Terms do not affect.
Yogen is an AI simulation engine. You submit an idea, question, or decision, and a swarm of AI agents (powered by the Anthropic Claude API) debates and analyses it, generating a prediction report.
Yogen is an informational tool only. Simulation outputs are not, and must not be treated as, financial advice, investment advice, legal advice, medical advice, or professional advice of any kind. See Section 11 for full details.
You may use Yogen only if you are at least 18 years old (or the age of majority in your jurisdiction, if higher); you have the legal capacity to enter into a binding contract; and you are not prohibited from using the Service under any applicable law or sanctions regime.
By using the Service, you warrant that you meet all eligibility requirements. We reserve the right to terminate accounts that do not meet these requirements.
To access the Service, you must register for an account. You agree to provide accurate, current, and complete information; keep your account information up to date; keep your password confidential; and notify us immediately at michael@yogen.uk if you suspect unauthorised use of your account. You are responsible for all activity under your account.
You may only hold one account. Creating multiple accounts to circumvent usage limits, bans, or free-tier restrictions is prohibited.

Unused simulations do not roll over. Allowances reset on your monthly billing anniversary. We will give at least 30 days' notice by email before any price increase. If you do not accept a price change, you may cancel before it takes effect.
All payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis. We do not store your card details — Stripe's PCI-DSS Level 1 infrastructure handles all card data. If a payment fails, we will retry. If payment remains outstanding for 7 days, your account may be downgraded to the Free plan until payment is received.
You may cancel your subscription at any time via your account settings or by emailing michael@yogen.uk. On cancellation, your paid plan remains active until the end of the current billing period. You will not be charged for the following month. Your account will then revert to the Free tier.
Your paid subscription renews automatically each month until you cancel. We will send you a reminder email before each renewal confirming the date, amount, and how to cancel. Cancellation must be completed before the renewal date to avoid being charged for the next billing period.
14-day consumer cooling-off period: If you are a consumer, you ordinarily have a 14-day right to cancel starting from the date of subscription. However, because Yogen delivers digital simulation content immediately, when you complete your subscription purchase you will be presented with a specific consent tick-box stating: "I request immediate access to Yogen's digital simulation content and acknowledge that by accessing or using any simulation before the 14-day period expires, I lose my right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, Regulation 37." By ticking that box and using any simulation, you lose your cooling-off right.
If you do not use any simulation within 14 days of subscribing and wish to cancel, contact us within that period for a full refund.
Statutory rights: Nothing in this clause affects your rights under the Consumer Rights Act 2015, including the right to a price reduction or refund where digital content is not of satisfactory quality, not fit for purpose, or not as described.
Refunds for service failures: We will issue refunds or credits where: a technical error caused failure to deliver simulations you paid for; the service was unavailable for more than 72 consecutive hours due to our fault; or the service materially fails to perform its described function. Contact michael@yogen.uk within 30 days of the issue.
You may use Yogen only for lawful purposes. You must not use the Service to:
We may suspend or terminate your account if we reasonably believe you have violated this policy. We will report unlawful conduct to relevant authorities where required by law.
Your inputs: You retain ownership of the ideas, queries, and content you submit. By submitting content, you grant us a limited, non-exclusive, royalty-free licence to process and transmit your content to the extent necessary to deliver the Service (including transmission to the Anthropic API). We do not use your content to train AI models.
Outputs: We make no intellectual property claims over simulation outputs generated for you. However, we do not warrant that outputs are free of third-party intellectual property rights arising from AI training data. You should not treat outputs as original creative works cleared for commercial use without independent IP clearance. We accept no liability for third-party IP claims arising from your use of simulation outputs. Note that AI-generated content may not meet the threshold for copyright protection under UK law (Thaler v Comptroller-General of Patents [2023] EWCA Civ 1445).
Platform: All rights in the Yogen platform — including software, design, architecture, branding, and trade marks — are and remain the exclusive property of Yogen (Michael Ruocco) or our licensors. Nothing in these Terms grants you any rights in the platform itself.
The Service integrates with Stripe (payment processing) and the Anthropic Claude API (AI simulation). Your use of the Service means your simulation content is processed by Anthropic's systems. Anthropic's terms apply to that processing. We are not responsible for the practices, content, or availability of third-party services.
We are committed to compliance with the Online Safety Act 2023. You must not use Yogen to generate, transmit, or seek to generate content that is illegal under English law, including CSAM, terrorist content, content facilitating serious crime, or hate speech. We will report illegal content to law enforcement as required by law. If you encounter illegal content through our service, report it immediately to michael@yogen.uk.
We aim to maintain a reliable service but do not guarantee 100% uptime. The Service may be unavailable due to maintenance, updates, or technical failures. We will give advance notice of planned maintenance where reasonably practicable. If we shut down Yogen entirely, we will provide at least 30 days' notice by email and pro-rata refund any prepaid subscription amounts for periods after the shutdown date.
(a) Accuracy: AI outputs may contain errors, hallucinations, outdated information, or logical inconsistencies. Outputs are not verified by human experts before delivery.
(b) Not professional advice: Nothing Yogen produces constitutes financial advice, investment advice, legal advice, medical advice, tax advice, or any other professional or regulated advice. Outputs are for informational and exploratory purposes only. Obtain independent professional advice before making any significant decision.
(c) Financial promotions: Yogen does not provide regulated financial advice and does not constitute a financial promotion within the meaning of Section 21 of the Financial Services and Markets Act 2000. We are not authorised or regulated by the Financial Conduct Authority. Nothing in Yogen's outputs should be construed as a recommendation to buy, sell, or hold any investment, security, or financial product.
(d) No reliance: We expressly disclaim liability for any decision made in reliance on a Yogen output. The weight you give to any output is your responsibility.
(e) Evolving regulation: The regulation of artificial intelligence is evolving in the UK. We monitor applicable guidance and will update our practices accordingly.
Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot lawfully be excluded or limited under applicable law, including the Consumer Rights Act 2015.
Business users: Subject to the above, our total aggregate liability for any claim shall not exceed the greater of: (a) total fees paid by you in the 12 months preceding the event; or (b) £100. We shall not be liable for any indirect, consequential, special, or punitive loss, loss of profit, revenue, business, opportunity, or data.
Consumers: We do not exclude liability for breach of Consumer Rights Act 2015 implied terms (satisfactory quality, fitness for purpose, as described) or for foreseeable losses caused by our breach or negligence. We do exclude liability for unforeseeable losses or losses not caused by our breach or negligence.
Force majeure: We are not liable for delays caused by events beyond our reasonable control, including natural disasters, civil unrest, or government action. AI API provider outages are addressed by our service-failure refund policy in Section 5.5, not force majeure.
You may request deletion of your account at any time by emailing michael@yogen.uk. We will process deletion requests within 30 days. Certain data may be retained for legal compliance (e.g. financial records for 7 years) — we will tell you what we are retaining and why.
We may suspend or terminate your account if you breach these Terms or if required by law. Where possible, we will give notice and an opportunity to remedy a breach first. If we terminate your account without cause, we will pro-rata refund any unused prepaid subscription.
Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
These Terms are governed by the laws of England and Wales. Business users: disputes are subject to the exclusive jurisdiction of the courts of England and Wales. Consumers: you may bring proceedings in your local courts (Scotland or Northern Ireland). Nothing in this clause deprives consumers of mandatory statutory protections in their jurisdiction of residence.
We will always attempt to resolve disputes informally first — contact us at michael@yogen.uk and we will try to resolve within 30 days.
These Terms constitute the entire agreement between you and Yogen regarding the Service. If any provision is unenforceable, the remaining provisions continue in full force. Our failure to enforce any right does not constitute a waiver. You may not assign your rights without our consent. We may assign ours on reasonable notice.
Notices: Notices from us will be sent to the email on your account. Notices to us must be sent to michael@yogen.uk.

We will notify you of material changes to these Terms by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
